EP Henry Fire Pit Kit Sweepstakes Official Rules
1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR
CHANCE OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED. The Design Home Sweepstakes ("Sweepstakes") begins at 12:00:00 AM Eastern Time ("ET")
on Friday, September 10, 2010 and ends at 11:59:00 PM ET on Friday, October 10,
2010 ("Sweepstakes Period"). Entries may be subject to verification
prior to prize drawing. No substitution or cash equivalent of prize permitted. Entry
in the Sweepstakes does not constitute entry into any other Sweepstakes, Contest
or Promotion. By participating in the Sweepstakes, each entrant unconditionally
accepts and agrees to comply with and abide by these Official Rules and the decisions
of EP Henry Corporation. ("Sponsor"), which shall be final and
binding in all respects.
2. ELIGIBILITY: The Sweepstakes is open only to legal residents
who are 18 years of age or older at the time of entry. Employees, officers and directors
of Sponsor and/or their respective parents, affiliates, subsidiaries, divisions,
advertising, promotional, fulfillment and marketing agencies, their immediate families
(parent, child, sibling & spouse) and persons living in the same households
as such individuals (whether related or not) are not eligible to participate in
the Sweepstakes. Void where prohibited or restricted by law, rule or regulation.
All applicable federal, state and local laws and regulations apply.
3. HOW TO ENTER: Limit one (1) entry per person and/or email address for length
of the Sweepstakes Period. Subsequent daily entries submitted by the
same person and/or from the same email address will be disqualified. For the purposes
of the Sweepstakes, a day shall mean a 24-hour period, beginning at 12:00:00 AM
ET and ending at 11:59:59 PM ET on the same day. Any attempt by a person to use
multiple email accounts to enter more than once may result in disqualification at
the discretion of the Sponsor. Entrants will be required to provide name, mailing
address, email address, day and evening telephone numbers, and may receive communications
or special offers from EP Henry from time to time.

(the "Sweepstakes Website"). Complete the Sweepstakes entry form with your true
and correct information and click the "Submit" button. After entering your registration
information and clicking on the "Submit" button, you will receive one (1) Sweepstakes
entry.
The Sweepstakes Website clock will be the official timekeeper for this Sweepstakes.
Entries will be deemed made by the authorized account holder of the email address
submitted at time of entry. In the event of a dispute regarding the identity of
any potential winner, the potential winner will be deemed to be the authorized account
holder of the email address submitted at time of Sweepstakes entry. The authorized
account holder is defined as the natural person who is assigned an email address
by an Internet access provider, online service provider or other organization that
is responsible for assigning email addresses or the domain associated with the submitted
email address. A potential winner may be requested to provide the Sponsor with proof
that the potential winner is the authorized account holder of the email address
associated with the winning entry. If, in Sponsor's sole determination, a dispute
cannot be resolved, the entry will be deemed ineligible. Entries generated by a
script, macro or other automated means will be disqualified. Entries that are incomplete
garbled or corrupted are void and will not be accepted. Except as noted in these
rules, information collected from entrant is used only for the purpose of the prize
drawing and to notify winners, and will not be re-used, sold or shared in any manner
by Sponsor or any third parties unless entrant has elected to receive additional
information and promotional material from Sponsor or a third party. Once the Sweepstakes
has ended, all information supplied by entrants will be removed from the promotion
database. In the event of any discrepancy between the EP Henry Corporation Privacy
Policy and these Official Rules, these Official Rules shall control and govern.

4. SWEEPSTAKES PRIZES, DRAWINGS, AND ODDS OF WINNING: A random
drawing will be held on or about Friday, October 10, 2010, to select one (1) Grand
Prize Winner from all eligible entries received. Odds of winning depend on the number
of eligible entries received.
One (1) Grand Prize Winner: The Grand Prize Winner ("Winner") will
receive an EP Hewnry Fire Pit Kit. Approximate Retail Value (ARV) of prize is $825. Shipping, if required,
is additional. Assembly is required or white glove delivery, including assembly,
is available upon request for a fee.
Total ARV of Prize is $825.
Prize Restrictions: No prize substitution, cash equivalent of prize,
transfer or assignment of prize (or portion thereof) permitted, except by Sponsor
in its sole discretion, or as otherwise provided herein. Sponsor reserves the right
to substitute the prize (or portion thereof) with one of comparable or greater value,
at its sole discretion. The difference between the ARV and actual value of the prize
will not be awarded.
The Sponsor will award the available prize to the Grand Prize Winner only upon that
grand Prize Winner's confirmation, verification and final approval by Sponsor. Any
portion of the prize not accepted by winner will be forfeited. All prize details
are at Sponsor's sole discretion.
5. PRIZE AWARDING: Limit of one (1) prize per person, household,
and/or email address. Prize will only be awarded upon potential winners' verification
and final approval by Sponsor. Potential Winner will receive notification that he/she
has won via electronic mail and/or phone. Prize Winner will be required to execute
an affidavit of eligibility, liability release, tax acknowledgment form and return
within ten (10) business days of issuance of notification. Eligibility, age, and
other claims made by Prize Winners are subject to verification. In the event a Prize
Winner is deemed a minor under the jurisdiction of his/her state of residence, the
Prize Winner's parent or legal guardian will be required to sign and return all
documents. If the potential winning entrant of the prize (i) cannot be contacted,
(ii) is ineligible, (iii) fails to claim the prize, or (iv) if the potential winner
otherwise fails to fully comply with these official rules, he/she will forfeit that
prize and that prize will be awarded to an alternate potential winner. Prize winner
grants Sponsor the right to use and publish winner's proper name and state of residence
online in connection with the Sweepstakes. Acceptance of a prize constitutes permission
for Sponsor and its affiliates to take photographs and/or video of the prize winner,
and use such photographs & or video, along with winner's name and likeness, for
any and all advertising and promotional purposes as Sponsor so determines without
notice or further compensation, except where prohibited by law. All decisions of
Sponsor shall be binding and final. The Sponsor does not assume any responsibility
for any disruption in the Sweepstakes caused by circumstance or other unforeseen
events outside of the control of the Sponsor. In the event there is a discrepancy
or inconsistency between disclosures and other statements contained in any Sweepstakes
materials and the terms and conditions of these Official Rules, these Official Rules
shall prevail, govern, and control. In no event will more than one prize listed
in Section 4 above be awarded.
6. DISQUALIFICATION: Entrants found tampering with or abusing any
aspect of this Sweepstakes, as solely determined by Sponsor, will be disqualified.
If disqualified for any of the above abuses, Sponsor reserves the right to terminate
entrant's eligibility to participate in the Sweepstakes. Any attempt by any person
to deliberately undermine the legitimate operation of the Sweepstakes may be in
violation of criminal and civil law, and, should such an attempt be made, Sponsor
reserves the right to seek damages from any such person to the fullest extent permitted
by law. Sponsor's failure to enforce any term of these Official Rules shall not
constitute a waiver of that provision. Sponsor reserves the right to terminate,
cancel, suspend and/or modify the Sweepstakes if any fraud, virus or other technical
problem corrupts the administration, security, or proper play of the Sweepstakes,
as determined by Sponsor in its sole discretion. In such event, Sponsor reserves
the right, but not the obligation, to award the prize at random from among the eligible,
non-suspect entries received up to the time of the impairment.
6. LIABILITY & RELEASE: By entering this Sweepstakes, entrants
and Prize Winner: (1) agree to be bound by these Official Rules; (2) agree to release
Sponsor, its subsidiaries, affiliates, divisions, advertising and promotion, fulfillment
and/or judging agencies, as well as the respective officers, directors and employees
of each (collectively, the "Released Parties") from any and all liability for any
loss, harm, damages, costs or expenses, including without limitation property damages,
personal injury and/or death arising out of participating in this Sweepstakes, or
the acceptance, possession, use or misuse of any prize and claims based on publicity
rights, defamation or invasion of privacy and merchandise delivery; (3) consent
to the use of their entry, name, voice, picture, and likeness for advertising and
promotional purposes in any medium throughout the world in perpetuity without additional
compensation unless prohibited by law, (4) acknowledged that the Released Parties
have neither made nor are responsible or liable for any warranty, representation,
or guarantee, express or implied, in fact or in law, relative to any prize, including
but not limited to its quality or fitness for a particular purpose. Sponsor may
discontinue this Sweepstakes at any time, and (5) agree to release and hold harmless
the Released Parties, including but not limited to EP Henry Corporation, its parents,
affiliates and subsidiaries and the respective employees, officers and directors
and divisions of each from and against any claim or cause of action arising out
of participation in the Sweepstakes or receipt or use of any prize hereunder, including,
but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b)
technical errors related to computers, servers, providers, or telephone or network
lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable
mail; (e) errors in the administration of the Sweepstakes or the processing of entries;
or (f) injury or death to a person(s) or damage to property which may be result,
directly or indirectly, in whole or in part, from entrant's participation in the
Sweepstake or entrants receipt, acceptance, use &/or enjoyment of any prize. In
no event shall the Sponsor be liable for attorney's fees. Entrant waives the right
to claim any damages whatsoever, including, but not limited to, punitive, consequential,
direct, or indirect damages.
7. GENERAL: Sponsor may terminate any Sweepstakes or decide to
modify it in any manner that it deems fair and equitable to participants if it becomes
aware of any occurrence that would materially affect Sweepstakes security and fairness.
Sponsor may prohibit individuals from participating in Sweepstakes and disqualify
entries if they (1) attempt to enter the Sweepstakes through any means other than
as described in these Official Rules, (2) attempt to disrupt the Sweepstakes or
circumvent the terms and conditions of these Official Rules in any way or (3) repeatedly
show a disregard for the Sweepstakes Official Rules or act (a) in an unsportsmanlike
manner, or (b) with an intent to annoy, abuse, threaten or harass any other entrant
or Sponsor. Sponsor's decisions with respect to the Sweepstakes are final.
8. TAX INFORMATION: All applicable federal, state, local, and other
taxes on prizes are the sole responsibility of the applicable winner.
9. DISPUTES: Except where prohibited, entrant agrees that any and
all disputes, claims and causes of action arising out of, or connected with, the
Promotion or any prize awarded shall be resolved individually, without resort to
any form of class action, and exclusively by the appropriate court located in the
State of New Jersey. All issues and questions concerning the construction, validity,
interpretation and enforceability of these Official Rules, entrant's rights and
obligations, or the rights and obligations of the Sponsors in connection with the
Sweepstakes, shall be governed by, and construed in accordance with, the laws of
the State of New Jersey, without giving effect to any choice of law or conflict
of law rules (whether of the State of New Jersey or any other jurisdiction), which
would cause the application of the laws of any jurisdiction other than the State
of New Jersey.
10. WINNERS LIST: To receive the list of Sweepstakes winners, send
a #10 self-addressed stamped envelope for receipt by November 17, 2010 to EP Henry
Design Home Sweepstakes, P.O. Box 615, Woodbury, NJ 08096.
